While I am hopeful for this current outcome, I am skeptical that the federal government will allow anyone to question their power and control. If they allow this, they have to allow other suits. It seems likely they will deny it completely or push it back to the college / university to accept responsibility (in spite of the fact that the federal government strongly suggested everyone get the shot, but didn't quite make it mandatory at any point). After all, there is a history of the federal government refusing to accept blame and rarely admitting they were at fault after the fact but doing little to rectify the wrong.
I hear you! The SUNY colleges (controlled by a Board of Trustees appointed by the Governor of NY) also have sovereign immunity. The strategy to go after the federal government was purposeful even if it doesn't mean the case will be successful.
Do you know if the private colleges have sovereign immunity. Maybe persuing lawsuits against the private colleges is another way to get some accountability.
The bait and switch gives justification for the suit but all the covid shots were dangerous, untested and fraudulent (recall the CDC changed the definition of a vaccine midstream during covid). Where are the class actions against colleges for contract breach (substituting crappy online classes for previously paid for in person classes?)
Where are the civil rights actions against colleges for covid shot mandates? Mandating invasive injections is no different than mandating abortion or carrying a child to term or chemical or permanent castration. All invasive violations of bodily autonomy and criminal.
